Terms of Service

These Terms of Service ("Terms") are an agreement between you and GiftXD, LLC ("GiftXD, LLC," "we," "us" or "our"), which operates RedeemMyGiftCard. They govern your use of this website and of our gift card selling service in our Telegram bot, @giftcard_redemption_bot (together, the "Service").

By using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

PLEASE READ SECTION 20 CAREFULLY. IT REQUIRES MOST DISPUTES TO BE RESOLVED BY INDIVIDUAL BINDING ARBITRATION AND WAIVES CLASS ACTIONS AND JURY TRIALS, UNLESS YOU OPT OUT.

1. Who We Are

GiftXD, LLC is a Wyoming limited liability company registered with the Financial Crimes Enforcement Network (FinCEN) of the U.S. Department of the Treasury as a money services business. RedeemMyGiftCard is a name under which we offer the Service.

2. What the Service Is

We buy gift cards that you own and no longer want, and we pay you in cryptocurrency. This website is information only. It does not accept card details, payments or personal information. All sales happen inside our Telegram bot.

The Service runs on Telegram, which is operated by a third party. Your use of Telegram is also governed by Telegram's own terms and privacy policy. We are not responsible for Telegram's availability or practices.

The only official bot is @giftcard_redemption_bot, reached through the links on this website. We are not responsible for any other account, bot, group or person claiming to act for us.

3. Eligibility

To use the Service you must:

• be at least 18 years old and able to form a binding contract;
• live in a location we serve, as confirmed by the bot during sign-up;
• not be a person or entity named on, owned by or acting for anyone on a U.S. or other applicable sanctions list, and not be located in a comprehensively sanctioned country or region;
• complete identity verification and keep your information accurate; and
• use the Service only for yourself, not on behalf of anyone else, unless we have approved that arrangement in writing.

Which locations we serve can change at any time. We may decline to open an account, or close one, for any lawful reason, including when we cannot verify your identity or your location.

4. Your Account and Verification

Your account is linked to your Telegram account. You are responsible for keeping your Telegram account secure and for all activity carried out through it.

Because we are a regulated money services business, we must verify who you are. During sign-up, and at any time after, we may ask for your name, date of birth, address, phone number, email, a government-issued photo ID, a selfie or live photo for a face match, and other information or documents. We may use third-party identity verification and screening providers to do this. Verification may limit what you can do until it is complete, and higher limits may require more information.

You agree to give us true, complete and current information and to update it when it changes. You may not create more than one account or use anyone else's identity or account.

5. Selling a Gift Card

Accepted brands. The bot shows which gift card brands we currently accept. The list can change at any time, and a brand may stop accepting cards for the day when it reaches a daily limit.

Your offer. When you submit a card, the bot shows the rate and the exact amount you will receive for that card. The rate that applies is the one shown when you submit the card. Nothing is final until you accept the offer.

What you promise about each card. By submitting a card you confirm that:

• you own the card, because you bought it with your own funds or received it as a genuine gift;
• the card was not obtained by fraud, theft, deception or the unauthorized use of any payment method;
• you were not told, asked or pressured by anyone else to buy the card or to pay them with it;
• the card has not been used, redeemed, shared with anyone else or sold to anyone else; and
• the card details and balance you give us are accurate.

Checking the card. After you accept, we check and redeem the card. Some brands are checked automatically and some are reviewed by our team. If the card is invalid, already redeemed, has a lower balance than you stated, or cannot be redeemed, we will tell you in the bot. We pay only for the value we actually receive from the card, and we may adjust or cancel the offer accordingly.

Final once redeemed. Once a card has been redeemed, the sale cannot be cancelled and the card cannot be returned to you.

Keep your records. Keep the physical card and any purchase receipt for at least 180 days after the sale. We may ask for them to confirm a card.

6. Payment

We pay you in the cryptocurrency and on the network offered in the bot, to the address you provide. The amount shown in your accepted offer is the amount we send.

You are responsible for giving us a correct address that you control. Blockchain transfers cannot be reversed. If you give us a wrong address, or an address on the wrong network, we cannot recover the funds and are not responsible for the loss.

Payment timing depends on the card being checked and on our compliance review. We may delay or withhold a payment while we review a sale, as described in Section 8.

The value of cryptocurrency can change quickly. Once we send your payment, any change in its value is yours. You are responsible for any taxes that apply to your sales and payments.

7. Limits

We may set limits on the number or value of cards you can sell in a day, a week or another period. Limits depend on your verification level and other factors and can change at any time. The bot will tell you when a limit applies.

8. Compliance, Holds and Reporting

We follow U.S. anti-money-laundering and sanctions laws. To do so we may, at any time and without notice where the law allows:

• ask for more information or documents about you, a card or a sale;
• screen you, your cards and your cryptocurrency addresses against sanctions lists and blockchain analytics;
• delay, hold, refuse or cancel a sale or a payment;
• limit, suspend or close your account; and
• report activity to law enforcement or regulators, which the law may prohibit us from telling you about.

We are not liable for any loss resulting from an action we take in good faith to comply with the law or to prevent fraud.

9. Prohibited Use

You may not use the Service to:

• sell a card that is stolen, obtained by fraud, bought with someone else's payment method, or bought because someone else directed you to;
• sell a card on behalf of anyone else;
• launder money, finance terrorism, evade sanctions or commit any other crime;
• give false information, use another person's identity or hide your location;
• interfere with, attack, copy or reverse engineer the Service or the bot; or
• harass our staff or other users.

If someone asked you to pay them with gift cards, it is a scam. Do not sell that card. Contact the card brand and report it at reportfraud.ftc.gov.

10. Reversals, Disputes and Fraud

If, after we pay you, a card is reversed, disputed, charged back, frozen, voided or drained by its issuer, or is found to have been obtained by fraud or to breach your promises in Section 5, you must repay us the amount we paid for that card on request.

We may deduct any amount you owe us from any payment due to you, suspend your account until it is repaid, and use any lawful means to recover it. You must cooperate with any investigation, including by giving us the card and receipts.

11. Fees

Our margin is included in the rate shown in the bot, and the amount in your accepted offer is the amount we send. Your cryptocurrency wallet or exchange may charge its own fees, which are your responsibility.

12. Communications

You agree that we may communicate with you through the Telegram bot, including about your sales, your account, changes to these Terms and the daily rates. These communications satisfy any requirement that they be in writing.

13. Trademarks and Content

Gift card brand names and marks shown on the Service belong to their owners. RedeemMyGiftCard is not affiliated with, sponsored by or endorsed by any gift card brand or issuer.

The Service, including this website, its text and design and the bot, is owned by GiftXD, LLC and protected by law. You may use it only as these Terms allow.

14. Third-Party Services

The Service relies on third parties, including Telegram, blockchain networks, card issuers and our service providers. We are not responsible for their acts, failures, outages or terms.

15. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT ANY BRAND WILL BE ACCEPTED, OR THAT ANY RATE WILL BE AVAILABLE.

16. Limitation of Liability

TO THE FULLEST EXTENT THE LAW ALLOWS, GiftXD, LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA OR LOSS OF CRYPTOCURRENCY VALUE, ARISING FROM THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT WE OWE YOU FOR THE SALE THE CLAIM IS ABOUT AND (B) ONE HUNDRED U.S. DOLLARS (US$100).

Some jurisdictions do not allow some of these limits, so they may not all apply to you.

17. Indemnity

You will defend, indemnify and hold harmless GiftXD, LLC and its members, managers, employees and agents from any claim, loss or expense, including reasonable attorneys' fees, arising from a card you submitted, your breach of these Terms, or your violation of any law or anyone else's rights.

18. Suspension and Termination

You may stop using the Service at any time. We may suspend or close your account, or refuse any sale, at any time for any lawful reason, including a breach of these Terms or a legal requirement. Sections 5, 6, 8, 10 and 13 through 22 survive the end of your use of the Service.

19. Governing Law

These Terms are governed by the laws of the State of Wyoming and applicable U.S. federal law, without regard to conflict-of-law rules.

20. Dispute Resolution and Arbitration

Informal resolution first. Before starting any claim, you agree to message us in the bot describing the dispute and to give us 30 days to try to resolve it.

Binding arbitration. Any dispute that is not resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration may be held by video or by documents. The arbitrator may award the same individual relief a court could. Either of us may instead bring an individual claim in small claims court, and either of us may ask a court to stop infringement of intellectual property.

No class actions. You and we may bring claims only individually, not as a plaintiff or class member in any class, collective or representative proceeding. YOU AND WE WAIVE ANY RIGHT TO A JURY TRIAL.

Opting out. You may opt out of this Section 20 by sending us a message in the bot that says you opt out of arbitration within 30 days after you first accept these Terms. If you opt out, or if this Section is found unenforceable, disputes will be heard only in the state or federal courts located in Wyoming, and you and we consent to their jurisdiction.

21. Changes to These Terms

We may change these Terms. We will post the new version on this website with a new effective date and, for material changes, tell you in the bot. Changes apply to sales submitted after they take effect. If you keep using the Service, you accept the new Terms.

22. General

These Terms and our Privacy Policy are the whole agreement between you and us about the Service. If any part is unenforceable, the rest stays in effect. Our failure to enforce a right is not a waiver. You may not transfer these Terms; we may transfer them in connection with a merger, acquisition or sale of assets. Nothing in these Terms creates a partnership, agency or employment relationship.
